Has anyone actually heard Incognito's voicemail besides the nfl and the team? A lot can be taken from the tone of how he said things. Just reading the transcript, the voicemail seems deplorable, but how can anyone fully judge it without hearing it for themselves?

Tone or not what matters is that Mrtin did not want to hear such things that is the key point many are missing.
 
Exactly and this should be a lesson to everyone! When you decide to act that way be it text or voicemail you don't have the luxury of telling the recipient how they interpret the message.
 
I'd be more interested in learning about more recent examples of this harassment. The voicemail is from back in April. I've seen pictures of Martin and Incognito out on the town smiling together in September. Did something happen since then? Other than Martin's poor play and removal from Left tackle of course. Just what was the motivation for all of this to hit the fan in November? The prank in the cafeteria doesn't seem like a legitimate reason for the breakdown, especially after seeing evidence of a friendship as recently as September. And finally, will the media ask these questions?

Probably because Martin figured out that he needed to get mental help, but if he quit the team for mental issues we wouldn't have to cut him a check, but if he leaves due to "bullying" then he gets paid ( and maybe gets to sue on top of that)

This thing about Martin doing this for money seems quite absurd since there is very little he can do to prove that the dolphins cause him to lose money at this point
 
THIS! Nailed it! Communications classes teach this and sexual harrassment laws do not take tone or setting into account whatsoever. All that matters, the ONLY thing that matters is how the recipient interprets the message.

In my opinion, most believe that this is Martin's endgame. Maybe he decided that the NFL wasn't for him, but the $$$ would be a nice consolation prize on the way out the door. I guess that my point would be "you do the crime, you do the time", and Richie did the crime. Dolphins will pay up.

I guess this reasoning make sense coming from someone that thinks marino equals the almighty GOD . when will people let go of the excuses and see this bozo incognito for what he really is , no one with any decentency makes remarks like he did , rationalize all u want , his words is his words ...... im beginging to think that some fans will excuse anything , for the sake of this football team . get over this clown , hes through with the dolphins and hopefully the nfl .
 
Apparently even the NFL and Dolphins haven't HEARD the voice mails. According to Armando, Martin has only submitted a transcript of the voice mails, not the actual audio itself. Curious.

Wait... did we ever get confirmation that Martin had any issues with this? All we know at this point is someone from Martin's camp(Parents or Lawyer) is claiming this. I dont know if the report of Martin sending Incognito a text saying he doesnt blame him is true or not, but if he did. Doesnt sound like Martin had an issue.

This is what I am trying to get people to understand. Dont defened Richie but dont hang the guy just yet either. No one knows yet all the details, facts to lay claim one way or another.

I have a little experience with EEOC issues. I am not an HR person though.

What I have been told by HR was that their responsibility starts the moment the chain of command is made aware of an issue. That is when liability starts. There are exceptions. That is probably why we are hearing phrases like "the culture of the locker room". Keep in mind -- Incognito is not his superior. He is a coworker. Martin had the responsibility to inform his boss if there is an issue (Turner is number 1 in the cross hairs).

The phins are following a HR playbook right now.
1) suspend the accused with pay during the investigation
2) inform the accuser that they should return to work and that there will be no retribution
3) if they refuse to return -- put them on paid leave during the investigation
4) fire the harasser or put them through counseling -- depending on the severity
5) formally inform the accuser that the corp has done everything reasonable under the law and that it is time to report back to work

There would be no EEOC liability -- assuming Martin has never informed anyone prior to now. If Cogs was his boss, and he was overly empowered, maybe the corp would have more liability. That might be why the "leadership counsel" angle is being highlighted right now too.

Most of the time the victim gets paid to go away once litigation begins. They don't necessarily have a good lawsuit, but it is cheaper than paying the attorneys.

The problem here is that Cogs, Cogs' Dad, and Martin are playing this out in the press already. So the cat is out of the bag. Where this heads, IMO, is going to depend on when people knew what and how pissed off Ross gets at someone. Will he be pissed at Cogs, Martin (or his parents), Philbin, Ireland, Aponte?

If someone is clearly wrong, or manipulating the system, I hope Ross aggressively goes after them.
