Biggane says Tannehill is not in the running to start and calls Philbin a liar

You can't say jack unless the patient specifically says that you are allowed to disclose that sort of information.


The contract part of this is between Hartline and the dolphins coaching staff and FO.

The medical matters are totally personal, and if Hartline asked Philbin to be hush hush about it, then that's what Philbin has to do.
 
It's a non-football injury. Doesn't matter that he was forced to miss a mandatory mini camp.

so if he pullec a dmx and rolled a motorycle in his off time as a non football injury that would be viewed the same??? it's non football
 
its a personal matter until it starts effecting your job requirements...and in hartlines case mandatory mini camps are required...if its volunteer (wink wink) otas no big deal but mandatory stuff i think it should be disclosed...

If a player's mother dies, in your opinion is Philbin required to announce to the media that this certain player is missing time because their mother died? Or is he allowed to say that the player is dealing with a personal issue?

i'm sure there's a policy in force for family members death etc...i don't consider that the same thing as being out cause your appendix was removed...

Yes. You don't generally see teams commenting on that. They can put a guy on the non-football-injury list, which implies an injury, but as long as they don't really comment on it they're not running afoul of the laws. The injury usually gets out, but that's because of reporters and whatnot. Also most of the time the players themselves go ahead and say what's wrong, as Hartline did here. Nonetheless, the teams aren't supposed to comment.
 
Let me put it this way, HIPAA laws at your work place don't suddently not apply just because the employee was forced to take a few sick days. That employee's boss STILL cannot divulge the private medical information (even to the extent of saying that it's a medical issue) with anyone unless the employee gives permission to do so.

We go through H.R. training on this **** all the time, every year. Obviously Brian Biggane doesn't.
 
i'll have to ask my wif...she's an hr manager for a large corporation...
 
So a surgery that is non-football related is not a "personal issue" ?????? Sounds like a personal issue to me. and then this writer even calls Philbin's integrity into question?

so.. Biggane? ok, never heard of him, but will make a mental note to put him on my "THIS WRITERS SUCKS ASS, ELECTROLYTE, DON'T PAY ATTENTION" list.
 
Medical issues = big time disclosure laws (HIPAA). Philbin did the right thing and it doesnt matter one bit how it affects Hartline's job performance.

You are right, they are not the same thing. In fact having a personal non-football related surgery has more restrictions with the law than saying someone had a death in the family. Though the basis of both situations is similar. Both accounts are non-football related and are considered a "personal matter". The team and player is not hiding anything, they are doing what is required by law and keeping a private matter private.

You are way off on your thoughts about this subject and the fact that really no one is agreeing with your view should help open your eyes.

first off slow down with this i'm way off crap...i could care less if everyones agreeing with me on something...it happens all the time and more often than not i'm right...that said i didn't say that miami did anything wrong here so don't get your dander up to defend the team for the millionth time it seems...i said i think that info should be disclosed if it effects your ability to perform under your contract...that's just my opinion...but others have informed me there are laws in place to protect the individual from such...i can see where that would be the case but i'd like to see what an nfl contract small print states...did i learn something new today i sure did and i will verify it with my wife...

can we have a damn discussion on here without you taking it as someone piling on your beloved dolphins...for gods sakes...

as for the biggane thing i agree with others he's making a mountain out of a mole hill and that calling philbin a liar was uncalled for...coaches skirt the truth all the time...

i'm not sure how differently this would be viewed if it wasn't a medical emergency such as an appendix instead of say hartline shooting some hoops with friends and tearing his achilles...i know that some non football related activities can effect contracts etc...i just don't know what is required disclosure wise
 
I just think Biggane should just update his post with an apology for insinuating that Joe Philbin lied on this matter, and that it has been relayed to him that there are laws preventing Philbin from saying more about Brian Hartline's private matter than what he said.

I mean, if I wanted to be mean, I would accuse Biggane of simply acting butt-hurt because he didn't know something which evidently he could have easily found out if he did ANY amount of legwork whatsoever. One quick visit to Brian's twitter page and it was apparent to me that he had some sort of surgery. Put two and two together between "private matter" and "surgery" and that gives you about 90% of all you really need to know, with the remaining 10% being "he should be back by training camp".
 
as a nurse myself, absofreakenlutly this is a HIPPA violatation if philbin went ahead and told the reason why he was out. He did the best thing he could do. I call the reporters integrity or at least knowledge of his job into question for not knowing something so basic that they would have been covered in the basis of his profession.
