Charges may be refiled in Culpepper case.

I don't understand why the Prosecuter won't get off of Culpepper's nutz.....he was just throwing dice. Guess the DA wants to make himself look like a big man. I bet Childress put him up to this. :mad:
 
I'm not a lawyer, but I did stay at a Holiday Inn Express last night.:goof:

Anyway, maybe JJ or another lawyer could address this. Why is this not double jeopardy?
 
Double Jeopardy only occurs when you are tried in a court of law. In other words, if you are accused of a crime and acquited of that crime, you can not be tried for the same crime again.
 
It wouldn't be double jeopardy if the charges were refiled because he was never tried the first time the charges were filed. He can only be tried once.

He because he wasn't tried and found guilty. The case never went forward due to lack of evidence, therefore if more evidence does come about, they can try the case.

No lawyer, but I too stayed at a holiday inn last night.

You're right except you don't need to be found guilty. In fact why would anyone charge someone with a crime that they have already been found guilty of? Double jeopardy is when you are tried, found innocent and then charges for the same crime are brought again.

IMO the DA has been looking to make a name for himself the whole time. That is why the NFL players were charged and the average Joes who work on the ship weren't. Now what the DA overlooked is that the average Joes are white and the NFL players are black. So while he may not of intentionally brought charges based on race it sure looks like it. So now he has a decision to make. Does he still press on to make a name for himself, when the name he creates could very well be that of a racist or does he let this go and fade into obscurity.
 
i still never knew it was illegal to have strippers on a boat.....and if there was lude conduct....wouldnt it be the strippers pressing charges??
