Dolphins | Team wants quick appeals process for R. Williams
Mon, 27 Mar 2006 20:24:34 -0800
Jason Cole, of the Miami Herald, reports the <A href="http://www.kffl.com/team/22/nfl">Miami Dolphins have asked the NFL to give them quick notification on RB Ricky Williams' results on his appeal for violating the league's substance abuse policy. The team would like to prepare to draft a possible replacement for Williams in case he is suspended for one-year. Attorney David Cornwell, who is representing Williams, said, ""I will tell you that in the past, when circumstances have dictated the need for a quick turnaround on the ruling, the arbitrator has taken it at his discretion to issue a short-form ruling and then issued a longer one when he can."

No, it would be the same decision.

Writing arbitration decisions is a lengthy exercise. It can take a long time to get the long-form.

What they are asking for is the brief statement of the decision, without waiting for the full text of the decision.

I don't know about the NFL, but in my union arbitrations it can take months to get the full decision, but usually 24 hours to get the results.

How about John Avery?:sidelol::sidelol::sidelol:

Yeah I need to know the short-form ruling asap, so I can know if I need to get a new Dolphins jersey or not.

Does anyone with knowledge of the appeal process actually know how it works. Is Ricky going to have to prove what caused the positive drug test, or do they go on other factors. I guess I'm a little confused on what will actually be discussed and how difficult it will be for him to prove that a legal substance caused the positive test.

Any help would be great here!!!!

This is just a guess, but I would assume that if they need an immediate decision in the interim, that is bodes well for Ricky. The arbitrator may say, that until he thoroughly reviews any and all evidence, that Ricky is allowed to participate in workouts, mini camps, and play, until the final decision comes down.

At that point, if the arbitrator were to find Ricky guilty, the suspension would be immediate and for a minimum of a year, from that date. The problem is, if they say he can play in the interim and the issue of getting a backup goes away until lets say, July. Then all of a sudden he is gone for the year and we areleft with no viable backup. That would be the risk we take.

It could mean that it goes the other way too and that he would be suspended until further notice. However, that could mean that Miami and Ricky would be unfairly punished and how do you compensate them for that?

Again, this is just a guess. I have NO knowledge of how this whole process works.

The first reply was correct. the decision wouldn't change, but the full report would take longer to write up than the dolphins want to wait. they can get a quick notification of the decision before the report is finished.

So Ronnie Brown's 65 yarder (TD) and 58 yarder weren't "break away" enough for you? I remember, back in the day, when us Dolphin fans would give our left testicle just to see a Miami RB bust on for more than 20 yards. I'm not kidding either, a 25 yard TD run would invoke oooohs and ahhhhs from us all. So when our rookie RB busts of two runs of 50 or more yards in a season in which he shared carries with another star back, show some respect, please.

Hah! Remember that Bernie Parmalee 5 yd leap into the end zone? Man, I thought somebody had stolen that guy's kryptonite.

I also think that the lawyer is suggesting that the NFL will be sued for breach, as I so briliantly pointed out while eveyone in creation was badmouthing Ricky and judging him guilty. There is much more here than meets the eye or that is being reported. There is money involved here with a breach of law, not NFL rules. It is law, and Paul Tagliabue knows this. Rickys value and worth were breached, and when that becomes the issue with a breach, a lawsuit follows. That is why a quick decision could be forth coming. Notice this isnt his agent, this is a lawyer who is now doing the talking. No comment says the NFL. :D

If Ricky tested positive during an NFL drug test, (be it a false + or a true +)
the NFL is no breech of law.
The NFL did not report the test result nor have they stated what the positive test was(ie marijauna, cocaine, steroids) so they have not breeched any law.
