An Orange County judge ruled Friday the family of football player Ereck Plancher can seek punitive damages in the wrongful death lawsuit filed against UCF Athletic Association.
Circuit Judge Robert M. Evans added a jury must specifically find that no water and no athletic trainers were present for the final portion of Plancher's workout in order to award punitive damages.
Evans emphasized that his decision was based on judicial precedent and he was making no determination about the accuracy of wide receiver Anthony Davis' statements alleging UCF coach George O'Leary ordered athletic trainers and all water to leave the indoor practice facility.
