I never thought the report would get Philbin fired... I didn't think he was aware, and he wasn't. But that still makes him clueless.
Personally, I'm not sure about Philbin. There are a few suspect things he has done that are odd as a leader. I don't know if he is clueless. That is a bit overboard. I can't help but wonder how much worse the team's image will get tarnished with a gay player coming out this year. the comparisons will continue unfortunately so there is the concept of just starting fresh so it is truly in the past. I don't think that is best for Miami football in 2014, but Ross has to think about it as a business man. It is also unfortunate that the report was delayed, in makes Miami look slow to react.

Just a small nitpick here. But, this is on p. 21 of the thread and it is like the 5th time I've seen it happen to you, so I wanted to let you know.

The words you want are law suit, sue, and sued.

Your spell checker is changing these to the thing a person does with a needle and thread that sounds like the word "so" and while we all know what you mean, your spell checker is autocorrecting them to the wrong words.

Spelling is not a big deal, but this time it actually is a different word, and kinda comical. So unless you are talking about a patch on a uniform or something, double check that spell checker before hitting enter.

FYI, I post from my phone often and get crazy unintended auto corrects too, so don't sweat it. I just wanted to give you a heads up it was happening.
 
I agree with you he is opening pandoras box but the issue here is who is he sueing? By all accounts the Dolphin org is not responsible for any wrong doing here. He can sue the individual players. And further he will have to prove that the Dolphins casued for him to longer be able to get a job in football..... Tough road. This is a suit that the NFL could not afford to settle either bcause if they did they would open themselves up to countless claims of the same thing.

BINGO! That was the crux of it and always was going to be.

Wells was hired by the NFL and invited by Ross for one reason only, damage control. This clears a path for Martin to sue and settle outside of the NFL and creates no precedent against the league.

Now the NFL can implement policies and show that once they learned of the problem it was dealt with swiftly and a reasonable system was put in place. Martin knows he did not follow proper channels. He knows he did not complain up the chain. He knows he did not contact his NFLPA rep and file a formal complaint. He Knows he skipped counseling. He Knows he avoided mediation. He understood and understands that those systems are designed to help the player and resolve the issue amicably.

He chose to opt out of all of those things and go straight to showing damages to ser up a law suit. Then his team released a partial text to intentionally show it out of context and look even more inflammatory. Then his counsel mischaracterized the "brutal physical assault" at the party where he was thrown down on a couch and didn't even have a bruise and then 10 minutes later went out to a club with the guy.

Martin wants a payday. Wells wants to insulate the NFL from future liability.

If that was a primary motivating factor, then why would he include the harassment of the assistant trainer? Having read the report, he's the guy with the strongest case. The report does nothing to insulate the NFL from that lawsuit.
 
I have read the full report and I am greatly saddened to read about my beloved team in this way. Reading many Finheaven contributor comments, it amazes me that so many seek to defend Incognito, Pouncey and Jerry and condemn Martin and others. The Wells Report appears very thorough and there does appear to be evidence of harassment.
I am not surprised by the findings, I thought that there was likely to be substance all along. I am disgusted and appalled by the nature of the report,
Time to clean house on the O-line. These players are meant to behave like professionals, Turner needs to be fired today by Philbin. Head Trainer O'Neill is on thin ice because he refused to cooperate with the investigation.
For anyone who is interested in the matter, my advice is to take the time to read the report and draw your own conclusions. For everyone who sees Martin as the culprit and Incognito as the victim, I urge you to read the report. The breadth of issues pertaining to the Asian Assistant Trainer and player A are also very concerning.
GoonBoss correctly assessed Martin as being weak, but with the evidence presented, I concur with Wells conclusions.
Root cause of the problem is that for all of Incognito's talent on the field, he is/was uncontrollable and should not have been the designated O-line team leader. Regardless of his popularity on the team, he is probably an alpha dog sociopath and he was the guy selected and encouraged to be the guy to toughen Martin up. Very poor decision (and Philbin, Sherman, Turner and Ireland hold some responsibility in both permitting it and not monitoring it closely). Sherman and Ireland are gone and it's a formality that Turner will be fired. Philbin needs a reality check in the circumstances.

I would like to take this opportunity to point out what I was going to before.

1. Philbin is in charge of his own coaching staff where we now know Ireland had no say in that.
2. Philbin was exonerated from "holding some responsibility" so you cannot say you agree with its conclusions and then disregard the other conclusion in the report.
3. Most of all the noted bullying and texting went on off the field with the pranks that Martin was involved in was in-building.

So people ask how Philbin could not know?

Well, Wells said so so it must be so. I mean, the guy dismantled the Miami Dolphins but exonerated Joe.

So you may want to re-think your "conclusions"
 
I feel comfortable saying that this reads as a poorly researched, irresponsibly sourced, and improperly cited paper. Grade: C-

I've written better trash in an allnighter.
 
Jon Martin has internet PR people actually hitting up message boards to get the word out. This truly is a 21st century scandal.

THIS. All of a sudden there is an EXPLOSION of people who feel it vitally important to the quality of their lives that Incognito be perceived as being made the villain and as coming out on the losing end of this confrontation.

martin started the problem and has manipulated his family's connection, the media and the sociocultural realm of the Internet to try to destroy another man's career. This is a CRIME in my book. That isn't just name calling or texting a "n" word.

I am FED UP with the Internet commissars/thugs/"rise" people who jump on these situations.
