FINS FANS SCREWED AGAIN



The NFL is sticking it to the displaced fans of the Miami Dolphins once again. Like last year, when a hurricane forced the regular-season opener between the Fins and Titans to be moved from Sunday to Saturday, fans not residing within the local television broadcast area won't get to see the game live on DirecTV. Or on CBS. Or on the NFL Network. Or on ESPN. Or on any other channel.



The carefully-worded statement on the Dolphins' official web site never comes out and says, "Sorry, folks -- we've bent you over and crammed it up your bungholes sideways."



But that's the end result: The game will be available live on television in the local markets only.



On the radio, the game will be available on Sirius Satellite Radio and through the Field Pass subscription service.



Although some believe that the decision not to broadcast the game nationally is the result of a potential violation of "federal law," the reality is that there is no federal law prohibiting this. Instead, and as we explained in detail in September 2004, Title 15, Section 1293 of the United States Code states that telecasting a pro football game from a television station within 75 miles of any Friday night or Saturday from mid-September through early December jeopardizes the league's antitrust exemption.



As we interpret the law, the antitrust exemption arises regardless of whether the game is shown nationally or locally. If, as there surely will be, high school games are played within 75 miles of any of the Florida or Kansas City-area CBS affiliates broadcasting the game, the critical language of Title 15, Section 1293 is implicated.



In fact, because the law speaks in terms of games broadcast from any "telecasting station" within 75 miles of a high school or college game, the prohibition arguably doesn't apply to television images broadcast from, you know, a satellite orbiting the planet.



Adding insult to insult is the failure of the NFL to offer any explanation for the decision. Rich Eisen mentioned the non-availability of the broadcast briefly on Thursday night's Total Access, but then shifted quickly back to a discussion of the hardships that the teams involved will experience as a result of the unexpected acceleration of the game.



C'mon, league office. Plenty of the fans are smart enough to see through this, and everyone deserves an explanation as to why the game won't be seen on live television -- especially those folks who purchased the Sunday Ticket package with the expectation that the Dolphins and Chiefs games would be available.



And since the disruption of Miami games due to hurricanes now appears to be an annual phenomenon, shouldn't the NFL be taking steps to protect its fans against being prevented from watching their favorite teams play? Those billions in broadcast rights packages flows from the fact that people want to watch the games. So whether it's by lobbying Congress for an amendment to 15 U.S.C 1293 or whether it's through putting the appropriate language in the contracts with the networks, the NFL needs to show a little more sensitivity (okay, a lot more sensitivity) to its paying customers.

Nail-on-the-head syndrom. As a 6 year subscriber to the Sunday ticket, I never once recieved an apology from the likes of the NFL or DirectTV themselves for not airing every game, but yet the rates don't stop rising. Typical polotics. There is nothing to forbid the above mentioned corporations to make a "bend" in the policy ( maybe with ESPN ) to accomodate these games (TN last year, KC this year, and the games coming up in the future.) Just typical corporate BS. There are ways around it, they just don't care to explore them. Thats what gets me. NFL ... Not Feeling Love.

We are not extending the telecast to more markets because we want to adhere as closely as possible to the spirit of our longstanding policy not to conflict with high school and college football during their seasons (which means Friday night and Saturday)

People on the board have mentioned it, and I didn't believe it at first, but it turns out that there is actually a law on the books, United States Code, that prevents the NFL from showing the game nationally.

The first sentence of section 1291 of this title shall not apply to any joint agreement described in such section which permits the telecasting of all or a substantial part of any professional football game on any Friday after six o’clock postmeridian or on any Saturday during the period beginning on the second Friday in September and ending on the second Saturday in December in any year from any telecasting station located within seventy-five miles of the game site of any intercollegiate or interscholastic football contest scheduled to be played on such a date ifâ€â€
(1) such intercollegiate football contest is between institutions of higher learning both of which confer degrees upon students following completion of sufficient credit hours to equal a four-year course, or
(2) in the case of an interscholastic football contest, such contest is between secondary schools, both of which are accredited or certified under the laws of the State or States in which they are situated and offer courses continuing through the twelfth grade of the standard school curriculum, or the equivalent, and
(3) such intercollegiate or interscholastic football contest and such game site were announced through publication in a newspaper of general circulation prior to August 1 of such year as being regularly scheduled for such day and place.

Technically, this law even prevents the game from being broadcast locally!

So if everyone from outside Miami would like to see the Dolphins game the next time something like this happens, you need to write your congressman. Let's get a letter writing campaign started people!
 
They have it right. This is more about the NFL having contracts with CBS, Fox and ABC/ESPN than anything else. It is about money! The NFL does not want to upset FOX or ABC/ESPN by televising via CBS on a Friday night. Since most games are played on Sunday, both CBS and FOX have games slotted to compete against each other. Likewise, ESPN/ABC have their Sunday and Monday evening gig. It is a big happy family between the NFL and the networks.

A Friday evening telecast on CBS would piss off the other networks that have shows that can currently compete with the usual CBS Friday evening show. The NFL does not want to upset the networks, instead they will hide behind the other excuses, such as Friday night high school football. It is all about the money!
 
The problem is that nobody will decide to boycott DirecTV or the NFL. Their desire to watch NFL games outweighs their irritation with the NFL's broadcast policies and DirecTV's monopoly. The one entity that desires nothing more than to keep these archaic rules is DirecTV. They have the NFL market cornered, and without it their already-niche market would suffer. However, the non-DirecTV market far, far, far outnumbers them.

Sports bars wouldn't suffer. Those of us who live in a local NFL market know that people STILL pack the bars, even with the games being on local TV. They can be watched anywhere - any restaurant with a TV or any couch - and people still flood the bars. It's the food, the atmosphere, and the football fanatics - not just the fact that they carry a game you otherwise can't see.

If the NFL wanted to make money, they would make the out-of-market games available to cable companies. There are any number of options for this - a season-long package would expose them to far greater numbers of people. Pay-per-view - all games for the week, or just an individual game - would no doubt be successful. Why don't they do this?

If anybody has a good answer, let me know.

Yeah, like PFT knows what they are talking about ?? They are getting better than in the past (as far as printing only speculation and hearsay with no facts or sources to back it up), they still interject too much opinion in their statements...I took it as what is was, mostly BS...

No kidding -- the Friday night high school football thing is totally ridiculous. I mean do you think I just came down with yesterday's rain?
 
I think it has something to do with gambling. they would rather have people go out and see their HS football games, then sit home and bet on the pro game. Only logical thing i could think of.
 
I really wish everyone would quit friggin whining. I'm pissed off too. But do you think the NFL and Direct TV care more about a few whining Dolphins and Chiefs fans more than their business relationship w/the TV networks? It's a business decision. Just watch it on NFL.com or get the free Field Pass and be pissed off about it.
 
You know i feel so much better now. If i had a party I'd fill the room with pinatas have a few tequilas and spread my love around the room with candy!
