Not if faking the punch was in "self defense". Burress was harassing the guy.

Burress wouldn't press charges. He already got embarassed twice.

if u are being harassed and commit a criminal offenses because of it, u are still guilty. Burress would have to of put reasonable belief into the guys head in order to call it self defense. and from the very little of the story we know, so far i don't think there was reasonable belief.
