The arbitrator in the Culpepper case will be John Feerick, and if his name sounds familiar, it should. Feerick is the NFL's former Special Master, the former dean of Fordham's law school, the arbitrator who reduced former NBA all-star Latrell Sprewell's suspension for choking his former coach, P.J. Carlesimo, and the man at the center of the Steve McNair hearing in Tennessee last year.

It is not looking good, but I wonder if Daunte wins the case if it means we must realease him immediately. I was think it maybe meant we just need to let him use our facility and practice at TC. If so, we could try and workout a trade before TC and see if he decides to rework his contract with the other team, kinda like KC did with Green. If we are aloud to do that, then we have three weeks before DC is release. As many of us know already, in three weeks alot can happen in the NFL.

He already has FULL USE of the facilities and can even be ON THE PRACTICE FIELD, on the sidelines that is. He has CHOSEN not to do that but spend his time in the weight room, and calling press conferences to hand out media press releases.

That is why I think the Dolphins have a shot at winning. He actually has not been barred from anything except taking actual snaps on the practice field, which is always at the discretion of the Coach, as it should be. he decides who gets what practice snaps. If the coach doesn't need to see you or forwhatever reason, he can hold a player out of snaps on the field. Anything else is an intrusion into his coaching and I doubt the NFL will allow him to win. If you do then you can and will have players all over the NFL petitioning the NFL because "they didn't get enough snaps" at practice.

Psssst, that exactly what was wrong with the past regimes. Mueller has set himself aside and showed his has cojones and if there is someone who knows how to put his foot down with things like this it is Mueller. Who would have ever thought we were gonna get a 6th for Mare or a 2nd & 7th from the Pats for Welker. As far as releasing Daunte, yeah right. The Phins keep Daunte and try to workout a trade, he wants to get back at us. When this is all said and done we might just be the ones with the power in our hands.
 
Im not advocating to do this but wonder if its in the dolphins legal rights to do so. Can they dictate how hard he drills? In other words can they make it a living hell for him when he is practicing through not endangering him but maybe making him do exhaustive drills or just dumb ones that drive him crazy? For instance: can they make him drop and do 25 push ups after each snap he takes?

I really think the NFL needs to really look at the way contracts are structured. The way things are done currently really leaves alot to be desired.
The franchise's try to hedge thier bets against injuries and declining performances, by designing contracts to be broken. Players in turn demand large signing bonuses and have formed a players union to counter.
Both parties entered into a legally binding contract and both parties should be forced to hold up thier end of it.
I realize this isnt the case but IMO Miami should have to pay out the entire contract or find someone to buy it from them and DC should stop complaining and do whatever the organaztion asks of him thats within the provisions of his contract. The team is not obligated to start him or even have a competetion. If they dont want him at thier faculities and they want him to pay him to stay home the franchise should have every right to do so. I know it will never happen, its just my little fantasy.
 
I think 8480 is misinformed...Cpep has not been barred from the facility or from practices. He was told he would not be getting any team reps is all. He is the one who chose to not be on the field with the rest of the team. His major complaint (at least as I see it) is simply that he wants out of his contract so he can negotiate with the team of his choice. Being his own agent has muddied up the water some and some of his comments to the press are perfect examples of that. However, the bottom line is that he is trying to force the Fins hands to release him and they feel he might be able to be traded somewhere to recoup a portion of the money and pick we paid for him. Even if the arbitrator denies his request, he can still continue to refuse to negotiate with any potential suitors for a trade thereby eventually forcing the Fins to release him. The Fins on the other hand can wait until just before the season starts to release him if they wish. In this case, I feel that Cpep has made his bed (partly because he wasn't the talent that Cam wanted and partly because he hasn't been healthy) and now must lie in it...

That all said, because it is an arbitrator known to lean towards the player, I think he'll get his release...or perhaps Mueller will release him just before the hearing...
 
Too bad the Fins can't file a grievance against him for refusing to renegotiate his contract....

If he is not allowed to practice with the team, that IS being BARRED from practice. Heck, he can lift weights and run at home!!.....Cam is not allowing him to compete for a job on the team, I believe that is what the complaint is about. So what he can lift weights, run and WATCH practice...what the hell is the point of watching other guys practice? When all he wants is an opportunity to compete for a job...and if they are not going to allow him to compete for a job then just cut his *** and be done with it. the situation should not be this complicated...

I have been misinformed, mainly cause this story is a he said she said. What you are trying to say is that Daunte was the one that walked of the field willing. If what you mean is that the Dolphins told him, look you can be on the field individualy and he decided to walk off , we might very well win this case.

The Dolphins can use the argument that if Daunte Culpepper has not passed a physical how are they gonna expose him to getting more injured. After all Trent Green when asked about Daunte said, I have been told he has not passed a physical
