A little fact about the Dolphins Union Rep on the Daunte Case...

"In regard to the Culpepper situation I have been in contact with Daunte throughout. We have communicated many times. I have also been in contact with Cam Cameron and Randy Mueller of the Dolphins. The situation that arose falls into the grey area that isnt clearly defined by the CBA. If it was clearly defined and the Dolphins were doing something wrong I would have informed them of their error and asked them to rectify the situation. I have done this on a number of occasions before and the team has always responded quickly. Because this is a case where it is not clearly defined the only way to proceed is to file a grievance and allow it to be settled judiciously. As I said in my statement to the press, "I do not have any problem with the way in which either Daunte or the Dolphins are proceeding." The job of the union is to represent the player if he desires to file a grievance...we are. The job of the player rep is to make sure the player is properly informed of what the CBA says and what his options are going forward...he was.

Then if thats there only job why is thier counsel stating this. i think the blog writer may have got it right. Arbitrartion is not called in on all matters, only where the league and union disagree just like any other union except these are much richer guys.

The NFLPA filed a grievance Tuesday on Culpepper's behalf, with hopes that the matter can be resolved within a week, said Richard Berthelsen, the union's general counsel.
"They're breaching his contract by refusing to employ him or letting him go someplace else," Berthelsen said.

How is what happened to Daunte "refusing to employ him"? He got paychecks, participated with the team, on the field, in the rooms, and in the gym. He wasn't allowed to participate in CERTAIN drills, that is all. If he has a real grievance, than EVERY player waiting to be traded or every 3rd stringer has a grievance. For the record, I've been squarely in the middle on this issue, I do not feel either party has done anything wrong. But that statement is just flat-out bunk.

Lawyers will file for anyone anywhere... it's in their blood. They can't help themselves.

Well D that is the way Daunte and his council stated it to have the arbitration hearing.

The real reason is that as Feely stated that is the grey area... the grey area that isnt clearly defined by the CBA... and that is the ones that causes them to be able to have a hearing and cleared out...

Any players that has an issue can ask for a hearing if the issue falls upon this "grey area." That is what Daunte did, asking for a hearing or filing a grievance does not mean the players is correct on the issue...

Exactly what I was thinking.
I always felt it was at the discretion of the HC which players participated in which drills. Let's say you are a 3rd stringer and he decides he doesn't want you taking reps that day. Do you have a legitimate grievance?
In DC's case HE walked off the practice field. Who knows if he would have gotten reps in TC. What if Grenn twists and ankle the 1st day of camp. Maybe they would have put DC in.
We will never know because of his conduct after that 1st day of mini camp.

They do. If players ran how they went they would all be sitting on lawnchairs sipping on lemonade all day.

True enough, Disn...that is why I felt the league may have "coerced" the Fins to resolve the situation before it went to the arbitrator...to avoid a 'definition' of that gray area.

Either way, I still feel, based on what I know of the CBA (which isn't much), but still feel that the Fins didn't do anything wrong here except try to recoup something for a bad investment...Cpep got paid, was able to rehab and even played a little last season (if that's what you call it) and still got his release. The Fins got nada from Cpep for the salary, bonus and draft pick they gave up...Oh well...another fine mess that Wanny created....(I say that because it was Wanny that left us empty of any QB potential when he left...)
