In my mind, that lets the Pats off the hook. 30 seconds left, your opponent has at least one timeout, and if you get a first down you can run out the clock. They can't beat you but they'd love to get a TD and make it closer. I'd pass on 3rd & 6 also.

Near the end of the game with the Eagles in the lead over the Cowboys, he had Randal Cunningham take a knee to run out the clock on 1st and 2nd down, then throw a bomb for a TD on 3rd down while Dallas was just standing there, hands on hips.
