The bigger question is should you allow any antagonisitc comments, which this clearly is. Because it is bound to provoke responses.

Listen folks, we have heard enough on the subject, and I think we all know the Jay issue has been discussed and re-discussed.

If we are going to open a can of worms, and start making everything someone deems offensive illegal, where do we stop?
