Is Martin Smarter Than The Average Cog?

What do you mean? It was just reported last night that he was suspended without pay and if the Dolphisn cut him he is owed his 4M but if they dont they will have to pay him nothing because of conduct detrimental to the team. Did something change from then till now?

When all is said and done, you will see that he is paid half of the last 8 weeks, and have to file a grievance for the other 4 weeks.

Unless Martin can prove that the phins FO was told or knew about the behaviors, he has no case against the organization. He could go after Incog., but how much would he really expect from him and be willing to go to court over ?

NOT true, the Dolphins had a responsibility to provide the work place, as the NFL knows.

how can the dolphins be responsible for anything, if they didn't know? This of course, all depends on if Martin told anyone within the organization...

Because they are responsible to know. Ignorance is no excuse.

in this case, I believe it is. I don't think the Dolphins, or any other NFL team is responsible in holding all players hands. They have certain channels to go through, for issues like this. It's up to the victim to go through those channels.

it would be like any other company. if a disgruntled worker is being bullying, he can't just go home, and sue the company, without first telling them the problem. They wouldn't have a snowballs chance in hell of winning anything.

As this unfolds, you will see the responsibility of the team, and the NFL. The NFL is unlike ANY other company on the face of this Earth. :)

What plan? I suppose they conned RI to call JM phone and threaten JM and JM mother right? As I said in another thread, I find it amazing that some people are blaming JM more for keeping these VM;s than they RI for actually sending them. Wow.

Was that before they went out to dinner in September 2013 as best buddies? Martin could have simply ignored them or told Incog to lay off. He knew that Incog was not serious.
That is what most folks would do. If you cannot see their angle in this...Wow.

HR violations in the work place, to start.
For him to get millions in damages, he'd have to prove he's suffered a million dollars worth of damage of some sort. What damage has he actually suffered that's valued in the millions?

Not every lawsuit works, folks. Many of them lose in court. This one would be a loser in my opinion.

From a financial standpoint, Cog was suspended and will get 4 weeks of his pay, and then Miami will very likely cut him, avoiding paying his last 4 weeks, which he may file a grievance on.

Martin is much more interesting. He "may have decided" that football was not for him, as per Stephen A Smith. Being a very smart guy, with a very smart family, he "may" have decided to set himself for one hell of a law suit vs the NFL, Dolphins, and Cog. His lost money would pale in comparison to the law suit, with the law on Human Resources in his back pocket.

Nothing but pure speculation on my part BUT, would that not be something to see? The smart guy taking some abuse, and fighting it on his terms to collect MILLIONS. Why save a voice mail for a year?

He would KICK Cog's ASS overall, and then some.

Again, NO FACT, just some fun speculation.

How is he going to make more money than he already was. This scenario makes not one bit of sense. He has started every game for the dolphins up until this. There was no reason to to think he was in danger of being cut next year. No matter what he would be making no less than a miliion a year for quite some time.

A tort for lost future potential wages plus triple punitive damages against the NFL? Nice work if you can get it.

He'd have to prove the NFL is responsible, and he'd have to prove that he's been damaged to the point that he's unable to resume the work that would give him those wages. Very unlikely IMO.

With the currency mint that the NFL has become, believe me they don't want to go to trial and possibly open the door for other such lawsuits coming out of the woodwork and in the future by setting a precedent if they lose. They are not a school district or run of the mill employer - if they don't have deep pockets, I don't know who does! IMO, Martin's parasitic lawyers are trying to touch all the legal hot buttons: racial hatred, hostile work environment and bullying to bring maybe multiple suits on his behalf against the NFL, the union for not protecting him and the Fins, knowing that the NFL cannot take the risk of losing, dreads the intrusion of one or both of the extortionist rabble rousing hypocritical "reverends" and as a result will be predisposed to settle providing the details are sealed. And what they will agree to settle for will make Martin's $mil seem like pocket change! IMO that's the play that's unfolding.

How is shouright criticized around here? He invariably has an excellent grasp of variables and probability. Certainly far beyond the posters who take the least likely outcome and pretend it's inevitable. A lawsuit won't happen, and if it does it will be unsuccessful. Heck, posters here have already provided pictures and info that would weaken Martin's case, if not prevent it from proceeding in the first place.

Brother, if he gets some shrink to say he's been traumatized and can never return to a locker room, they will calculate his loss earnings for the potentially lost years of his career.

I've been a manager of men from the military, to law enforcement, to my own business to my current career in the energy business .... I've seen this tried more than once.

Kindly post your proof that he did or did not tell RI to lay off. Also, he know or you knew. Stop making assumptions!
