And you know this how???Boomer said:BOTTOM LINE IS YOU DON'T HIT A WOMAN.
McMichael is a CHUMP for doing so. Plus, he kept on hitting her when he had knocked her down. That is just ridiculous.

It was a while ago, so I can't be sure how much the laws and procedures have changed, but this is what I remember. There's a few things that are being missed here. This is not a simple battery. RM struck a pregnant woman. (Yes, a push counts). This is a felony. It is on par with striking someone using a weapon. I doubt the wife can be charged with a felony. Most states have laws requiring prosecution when there are injuries in a domestic violence case. Those that don't usually have No-drop policies in domestic cases where the parties don't want to press charges. The most important issue here is whether the prosecutor feels there is enough evidence to pursue the case. I'm sure that RM's attorney will spend a great deal of time trying to convince the prosecutor that no charges should be filed. If they are filed, then I expect that speedy trial rules will be waived and that the case will be resolved after the season.
The NFL suspension thing is separate. I think it applies if a player admits to certain conduct, regardless of what his charge is. Either way, I doubt that there will be any suspension served this season. The NFL will wait until the case is resolved.

RM and his wife simply need counseling. This entire incident can make a marriage stronger only if they both learn from it and realize that they both will benefit from a mutual agreement to settle their differences by communicating and discussing them in a respectful manner.
Randy says he pushed her.Boomer said:Know what how? That you don't hit a woman????????????? I would imagine that was common sense and what you should have been taught growing up.
If you mean how do I know that's what he did......
" He told investigators Cawanna McMichael "hit him across the head with her hand," and his wife fell to the ground when he pushed her. McMichael's wife said her husband then hit her her several times."

He can claim self defense, and if all he did was push her, then i think a friggin jury would determine that he did everything very well under the circumstances to protect himself and others. I dont think, especially after changing her story 2 times so far that she is looking very good right now in front of a judge. If it were to end up a he said, she said, she didnt say (as far as i can tell) that he hit her first. He simply came home drunk and was puking in the toilet. Now if i am puking in the toilet and being yelled at by a pregnant wife who is all pissed off, who do you think strikes the first blow when he calls 911? If i am a juror, i am thinking RM did everything right. Im sure RM learned this in a seminar on this crap.
Agua said:Oh, I'm an attorney practicing 11 years now, so I understand very well what's up, though I've done very very little criminal work. However, the principle is the same in civil and criminal cases: if everyone agrees as to what happened, then there's no case as you said. BUT, that's why I said in the previous post that if it gets into "he said X, she said Y", there's a factual question (e.g., what really happened?) for a jury to decide. Anytime a question goes to a jury, it's a big die roll, so it would be in everyone's interest if they both just drop the charges, which as a practical matter, you stated previously and I agree with you.

So you only believe what the woman says?
finfan54 said:I think it is documented that she has changed her story twice now.
they both were in for Assault and Battery, not just RM, which leads people to believe that RM is the only one who is at fault here. Once again, the media is only out to get ya!
That's another issue that hasn't been resolved yet.... I won't be concerned until it's proven that he has a "habit"gunn34 said:I'm more concerned with Rickey's habit of puffing.
ohall said:I'm with you man. But obviously some of us must know he's guilty or something!? I don't know how else to explain some of the final determinations some are making, they must know more than we do. I know they must have been there. No wait...
