Fins might get some money but lose Ricky rights

Its simple bankruptcy law. Contract can be voided with bankruptcy. The key word is can be, not always.

Yes but the league can and will step in to stop that from happening. It may have to go to court again if RW tries to sue the NFL on the grounds that he's being denied the right to make a living but I doubt he'll win.

The NFL can place sanctions on a team that signs Ricky if he wants to play hardball and they will do that to protect the integrity of any future contract signed. I believe Ricky is screwed and that's what he deserves.

I'm not getting into the criteria part. All I've ever maintained is, that filing could get him out of his deal with Miami, which it can.

However other things will have to be met first.

The NFL rules do not overide the US Law. US Law governs everything in this counrty. Even the NFL.

If they say this is how its going to be then that is how it is. Regardless of whether or not we agree.

The NFL can argue the case and will argue it. However if it loses the case, then there will be nothing they can do.

Also if they do what you suggested in the second part. Huge fine.

No, the contract has a fixed expiration date. We have his rights through the end of the 2006 season. If he chooses not to play, we are under no obligation to pay him. However, in the spring of 2007 he would become a free agent.

the court cannot command the NFL to let someone play. that is up to the NFL. ever hear of Mike Williams? ;)

Exactly. All Ricky has to do to earn a living and have enough money to pay his debts is report for work. No judge is going to grant him bankruptcy simply because he chooses to smoke dope instead of work for a living.

Incorrect. We have his rights for 3 years. Ricky would have to show up enough each year to qualify for an accredited season. If Ricky decides to return to the NFL in the year 2025, we have his rights till the spring of 2028.

You're confusing two issues. Players need four years of credit in the league in order to gain unrestricted free agency. Ricky has already got that so accredited time is no longer relevant.

Contracts are for a set period of time. We have his rights until March 2007 and then he becomes an unrestricted free agent.

That is because the courts upheld the NFL rule.

Had they not then both would be in the NFL right now.

There is a precident for this. The NHL and Ottawa Senators sued a player after he sat out a year. The court agreed he signed a contract to play for x number of years, not until a certain date. He chose to sit out the final year, which meant he didn't play. Therefore, he hadn't fulfilled his portion of the contract and his rights still belonged to the Senators.
 
I think we should forget about the money and retain his rights for what 3 yrs. I think, so he can't sign with somebody else, especially in the AFC and bite us in the a**. It's a little like what Al Davis did to Marcus Allen only Allen was still on the team, but did'nt play hardly at all.:evil:
