Former Dolphins scout threatening to sue the team after contract not renewed

Since working from home is not protected the reality is they can often offer the choice of returning to the office or lose their jobs as a way of constructively terminating an underperforming employee as many can't change those work arrangements. This is assuming the Dolphins gave Sullivan the opportunity to return to the office.

That's correct, working from home is not a required accommodation, otherwise we'd all do it. I have several people in my office that take care of family members and would love to work from home. There's a woman, for example, who does use Intermittent FMLA as she likes, coming in late and so forth, when her disabled dad needs extra care in the morning. That's all she needs, and she's fine. If I told her she could just stay home and email in her reports and spreadsheets, supposedly under title 29 of the labor laws...she would probably laugh and not believe me.

I hate politics, what does that have to do with me talking about it? And the price (on average) across America has greatly increased. Consider yourself the very few top percent.
 
I think the bottom line is there's a big difference between saying we're letting you go because your wife is ill and saying we're letting you go because you refuse to work in the home office and only want to work from home in a different city. A big question would be are there other employees that have similar job requirements within the company and are they allowed to work from home out of town?

Must be nice my rates almost doubled. And that's not counting the deductible going up 6 times what they where.
 
Pointing out facts that counter silly statements that are essentially calling the scout lazy is nitpicking? Your (his) analogy doesn't even come close to the situation with the scout; so pointing out the flaw in such a comparison is not nitpicking, it's pointing out an error that negates the entire argument. Need more? Fine. The comparison doesn't work unless the teacher begins teaching the class from home because of a family member with disability and the class is able to be taught from home. He didn't just decide, "hey, **** this office stuff, I'm going to do this from home!" That would fit the analogy given. Again, that's not nitpicking. Considering the scout has been doing this for a decade and is the same job he did while in the office, it's safe to assume he was able to accomplish his work tasks of scouting game film.

However, if it is nitpicking, is nitpicking worse than making big assumptions like "he was fired because his reports suck" without anything to back it up other than the anger one has that their precious team is accused of doing something wrong?

Personally, I'm not going to make such assumptions. The team hasn't released why they fired him and likely won't. If they settle, we will likely never no because there will probably be a clause that prevents the release of that info. On the other hand, if they go to court, then we'll all know. I imagine the Phins would rather avoid the trouble and will probably settle if he opts to sue. Either way, he's an asshole in the eyes of many here simply because the Dolphins can do no wrong. I'll go ahead and wait to make such assumptions. Way too many questions. Was it performance-based? If it was just that Hickey didn't want him working from home, did he offer him the opportunity to come back to the office? If so, were they aware that it would likely require some kind of paid home care for the wife, which would likely increase the cost for the team? If they were aware, did that influence the decision to fire him? I could go on. Simply too many unknowns to say which side was in the wrong, if any. Therefore, blasting this guy because he said a meanie thing about the Glorious Miami Dolphins is ridiculous.

The fact that he used the Jon Martin situation to lend credence to his case is where he lost most of his credibility in my eyes. That makes it seem like he's grasping at straws to paint the organization like a civil, human and ethical rights violating machine of destruction.

I think people take advantage of these laws way too much and feel they are untouchable. We once had a guy that had diabetes and he used his illness to party late, come to work 5 hours late smelling like alcohol and would give us some nonsense about his blood sugar because he knew that was the buzz words to use in order to make him untouchable. So yes, people absolutely take advantage of these laws.

Hickey has the right to fire him if what he was offering wasn't what was in his plans for HIS scouting team, same as every other scout. Having a sick wife at home does not make him immune. Then using Jon Martin and the 'oh so terrible environment' the Dolphins run (which he didn't seem to have a problem with before) to strengthen his lawsuit is so....American... Come to think of it, I love this country, so many ways to make money. Lol
 
I might be a dick and a bit insensitive but I could make the case based on performance alone that any scout working for Miami the last ten plus years could be let go.

It isn't like Miami is setting the bar for scouting standards.

It is clear many of you failed to read the entire article. From the last paragraph:

Sullivan, who is not commenting on the advice of his attorney, was hired in Miami's pro scouting department in 1997 under then-head coach and de facto general manager Jimmy Johnson. Sullivan's job included reviewing game film and providing written scouting reports to the team's front office.

This is the 21st Century. He could watch film from the moon if he wanted to and it wouldn't impact his job duties one lick. His job is to review game tape and provide written scouting reports. He doesn't need to be in Davie to do his job well.

Hickey is simply being an authoritarian twit stuck in the 80s. For someone who touted his "new technological approach" to scouting, it is surprising to see him throwing a hissy fit over remote working.

If the facts laid in that article are correct, Hickey and the Dolphins are in the wrong, and anyone defending them are being defensive than for no other reason than they are fans. If this had been the story of any other corporation or business and an employee in a similar circumstance, anyone with a heart would side with the employee.

Well you just called someone out for not reading so it says "job included reviewing game film and providing written scouting reports to the team's front office." Know where does it say that was all he did in your quote. His job may also have included coming to scouting meetings every Fri we don't know.

But you know, if you think about it, it may have just been a softer way to let him go. He probably just didn't think much of him as a scout, and wanted to let him go, so he told him he doesn't need any long-distance scouts, he wants local ones.

That's possible. But even if he like his performance but said "I want all scouts in office so we can exchange info and maybe work some projects as a group in office. I want my scouts here so I can have face to face interaction and exchange of info. If you can't work here we don't need you." That's a lot different than "we're letting you go because your wife is ill."

I find it even more interesting that through this statement you seemingly approve of what Saban and Ireland did in this organization. :ponder:
