If he fired him because he didn't want him to work from home the dolphins have a problem.....if it was work related and documented then he doesn't stand a chance especially if Florida is a right to work state....
I agree with you about the suing part. I am not a litigious person. I think he is abusing the system a bit with this case. But it still doesn't excuse the Dolphins for not handling this appropriately.

Being blind works both ways. People believing their team is better than it actually is, and people believing their team is worse than it actually is. This clown is the latter.
Sir, I don't know you from Adam, all I know is you go around down voting every post I make. And now you call me a clown? It's as if my post have absolutely no merit. There was a time when I was overly optimistic about the state of this franchise. I gave them the benefit of the doubt over and over again, and every time I was burned. If I felt that the franchise was headed in the right direction, or if it demonstrated in any way that it is on the path toward correcting the many errors of the past my views may be a bit more positive. But they haven't, so here we are. They consistently make the same errors and mistakes, yet I get called out as a "clown" for simply pointing that out?
It is by nature difficult for a fan to look upon the state of their team without an optimistic outlook, I completely understand it. But being a fan often blinds us to the realistic outlook for the team. As fans, we cling to this hope that things are turning around, that finally the team will be good again, until it can no longer be ignored that we were once again on a dead end track. It's the sad life of a fan of a terminally bungling franchise. We have seen this cycle going on 6 times in the past decade. It always looks the same. Go back and revisit posts from the 2nd or 3rd year of Sparano's tenure. You will see the SAME overly-optimistic defenses and excuses for the team's failings as you see now for Philbin. And guess what, I was one of those "blinded by hope" fans back then. I've been that fan every since Wanny, each time clinging to hope that the team was in the precipice of breaking through. In fact, the only one I called an utter failure from the outset was Cam Cameron.
So please, refrain from calling me a "clown" simply because my perception of the team doesn't jive with yours.

Without having all the facts in this situation its hard to tell if he will be successful, but the dolphins did make reasonable accommodations for him then took it away.....
An employer cannot take action against you because you ask for your rights under the ADA. The Act also protects you if you are discriminated against because of your family, business, social, or other type of relationship or association with a person who has a disability. For instance, this means an employer cannot discriminate against you because your spouse or child has cancer.

While most people know that the Americans with Disabilites Act (ADA) protects those with disabilities from discrimination in employment, recent court cases have extended the protection to parents of children with disabilities. For example, if a parent of a child with cerebral palsy has to leave early to care for the child, the employer may not retailiate against the parent. The protections of this law are limited, but can be worth investigating.
In a little-used aspect of the ADA, the law prohibits employers from discrimination against employees who have an "association" with someone with a disability. 42 U.S.C. sec. 12112(b)(4). This law would prohibit a discrimination against “a qualified individual because of the known disability of an individual with whom the qualified individual is known to have a relationship or association.” Thus, a parent has a relationship with a child with a disability.
I think he can make life uncomfortable for the Fins, Hickey make not look to good when this is all said and done.
If you need to take care of your wife, you should quit and do it full time. The Dolphins aren't required to employ somebody and if they can't meet the job requirements then get a different job. Ridiculous and typical in this sue first and ask questions later society. No one is owed anything. If you aren't meeting the job requirements, the dolphins have every right to get someone in there who does. And it's irrelevant what a previous boss did or didn't do. This is Hickey's team now and he wants his scouts on premises. End of story.
So next I'm expecting to hear that if a scout has a gay son and he wants to live and work out of Tampa so his son can be closer to his boyfriend and the Dolphins say "that doesn't work for us" we're going to see headlines that scream "DOLPHINS FIRE SCOUT FOR HAVING A GAY SON!"
