Marshall victim wants justice, doesn't look good for Marshall

    The 24-year-old woman who alleges new Chicago Bear Brandon Marshall punched her in the face in the early hours of Sunday outside a Manhattan night club is a former basketball player at San Diego State University and has retained a high-profile attorney.

    Christen Myles is cooperating with detectives and met with her lawyer, Sanford Rubenstein, Thursday at the 10th precinct in Manhattan, according to a statement from Rubenstein.

    Myles, originally from Chino, Calif., told the New York Daily News, “my eye still hurts. ... I still have problem with my vision. ... I want him held criminally accountable for what he did to me.”

    According to the statement, Myles said Marshall “hauled back and punched her in the face, hitting her eye and caused her to be violently thrown to the ground.”

    “She has a serious eye injury. She’s under the care of a physician,” Rubenstein said. “She still has problems with her eye.”

    Rubenstein told the Tribune that there’s no consideration at this point into pursuing any civil lawsuits.

    “The focus is on the criminal aspect of the case. She’s concerned with getting justice,” he said.

    Myles was out celebrating her birthday with friends and family that night. Myles is currently in between jobs but moved to New York to pursue a career in media.

    I am amazed the Bears still traded for him, considering the details coming out. I wouldnt be surprised to see him suspended for the year if anything is true.

    As pissed as we all were initially, this trade makes total sense now.

    IF (BIG IF) Marshall get's any jail time or misses a majority of the upcoming season, then this is one of the best trades this FO has ever made!!

    Imagine how livid everyone would be if we didn't trade Marshall, and we find out at the start of FA that Marshall is involved in a criminal incident?

    Whether you think that the two 3rd rounders are fair compensation or not..... it could have been worse....
    We could still have the woman beater on our roster and nothing to show for it except a player wearing orange (prison outfit) or if suspended, we'd be without our #1 WR for the start of next season (which is how we go into next season anyways, just two 3rd rounders richer)

    If what she said happened acually happened, he'd have been charged. There are cameras everywhere at those clubs. They easily could have checked the tape and saw that Marshall's story checks out and hers doesn't.

    This sounds to me like a girl positioning herself for a pay day in civil court. The most laughable statement of all was, "Rubenstein told the Tribune that there’s no consideration at this point into pursuing any civil lawsuits."

    I mean seriously. What buffoon falls for that line?

    I suspect that if a strong wind knocked over a bottle and it landed on this woman's head, if Brandon Marshall was in the same room as her, she would say it was his fault.

    All about placing the blame on the guy with the $$$$$$.

    It still hurts us big time but I now see the logic behind it. If this is true then Marshall is in a bunch of trouble and it would have hurt us regardless. Imagine the distraction it would have caused along with his probable suspension. I still would have wanted at least a 2nd rounder. Either way it was the right decision.

    It was outside of the club not inside, and this girl played basketball at san diego state and has a college degree she is not some scum off the street.

    Those clubs have cameras on the outside too. Especially the outside, as a matter of fact.

    I'm supposed to be impressed she's a college graduate and former basketball player? She's between jobs, she's all lawyered up, and she's already bringing everything out into the court of public appeals. She's aiming for a civil suit I don't care what that lawyer says about their plans "at this point". LOL.

    Lets count the weird things that have happened to him (and those around him)
    *His limo gets shot up, teamate gets shot and killed

    CK, we don't know anything about the layout of this particular nightclub. Yes, most clubs have cameras in many areas, but it is not unreasonable to believe that this particular incident occured out of sight from the camera. To top it off, these cameras aren't exactly HD. With poor lighting conditions, things will look like a big blur. In the middle of a scuffle, it might be hard to see what exactly happens. Who knowas, maybe a big fat body guard got in the way of the camera as Marshall threw the punch.

    Night clubs. Nothing good happens at night clubs. He keeps going to those things, he's going to keep getting in trouble.

    I don't see what the big deal is the police would be all over this if the cameras didn't corroborate his story. I've been proposing we trade the man ever since it came out he has Borderline Personality Disorder. He's a ticking bomb. But this isn't his explosion. I'm being objective here, this looks phony.

    Hey I'm glad the Dolphins got out with him while they could, and I do think he will end up in trouble eventually. I just don't expect anything to come out of this particular incident.

    If it happened outside of a nightclub, especially a New York nightclub, it's on camera. That's a guarantee. Your point about the quality of video may be valid, but there's no way to tell.

    What I do know is that whether or not he actually punched the girl, he was involved in yet another legal issue. Once or twice, you can blame it on bad luck or coincidence. After it has happened as many times as it has, it's a pattern. Personally, I doubt he punched her. The guy has too much to lose, and he knows he is walking a fine line with suspension. More than that, someone who goes out as often as he does has to know there are cameras, especially in New York. However, there is no denying that the people he hangs out with are volatile at best, and that he consistently puts himself in bad situations. He could still get suspended, but I think it's too early in the process to be able to make an educated guess on that...

    Not saying it did or didn't happen, but regardless, this is her version of a Trip & Fall on a wet floor at Tiffany's. She'll go for the criminal conviction to set the groundwork for an easy civil suit slam dunk.

    But thats the problem, Brandon Marshall does not stop to think about the consequences to his actions. He explodes. He has a serious disorder, and that disorder makes him impulsive, explosive and violent. BM might understand that he is walking on thin ice, but when he is in the moment, that doesn't even enter the equation. He simply acts and reacts.

    Who knows if he actually punched her, but I have no doubts he escalated the situation in some way.

    Yup agree with this completely. Keep going to night clubs, even if you're smooth and think you're OK cuz your wife is with you, you're going to keep getting targeted and you're going to keep getting in trouble. Earlier in the thread when someone said that they imagine if a bottle fell off a shelf and hit someone in the eye, and Brandon Marshall is in the room, they're going to claim he did it...that's not far off the mark. Fights happen at night clubs and even if Brandon is just standing around, it gives people an excuse to claim he did something and then sue, hoping for a settlement.

    More likely the girl tripped, Marshall tried to catch her and her face bounced off his hands! Look close there might have been a goal line around the incident.

    Borderline Personality Disorder has absolutely nothing to do with impulsiveness, explosiveness, or violence. Borderline Personality Disorder effects how you interact with people and how histrionic you are with those interactions. You can have Borderline and be completely unimpulsive, calm, and non-violent. You described personality traits, not a personality disorder. I'm a clinical psychologist and deal with these people regularly. His disorder is absolutely the reason he has so many conflicts with people, but to blame physical altercations on it would be erroneous. Blaming this entire thing on his disorder is a cop out. Without knowing all the details, that would be my professional assessment, if anyone were to ever ask me...

    I believe her story, and that it will be increasingly apparent that it's accurate.

    Nobody screams civil suit in the early stages. A criminal verdict or settlement, or even publicized criminal scrutiny without enough evidence to go forward, increases the potential for civil relief.

    Cameras are a non-issue in a case like this. Clubs invariably focus cameras on two places -- employees in the bar area who may be ripping them off, and on entrances to verify to police and authorities that IDs were checked when appropriate. That issue, beyond any other, gets night clubs in legal trouble.

    If the incident happened outside the immediate scope of an entrance, it's likely not on camera.

    Besides, cameras are insanely overrated. The establishments want it that way, as a deterrent. Movies like Oceans 11 have applied a bizarre sophistication to surveillance equipment that doesn't threaten reality. I have friends who are undercover detectives in Las Vegas casinos who chortle over the impressions left by movies like that. Day to day those roaming guys are asked to check out situations that turn out to be completely harmless but the cameras believed to be sinister. Years after Oceans 11 made Las Vegas casinos look like impenetrable fortresses with cameras everywhere, a couple of hooded guys jumped over the desk at the Treasure Island cage and made out with a major score, scampering out the front door and onto the Strip. The cage didn't even have bars.

    If you want an accurate appraisal of cameras in a situation like this, take your impression of presence/effectiveness and divide by at least 10.

    No the alcohol beverage commision could careless about your camera on the door, especially since it won't show the age present on the id. Cameras are there to prevent theft and liabilty, with the increased violence in and around the vacinity of night clubs both the owners and the city have cameras outside. I see you are from Vegas well I can promise you every bit of the strip is on camera, this happened in Manhatten not east podunktown there is great security there.

    U dont know where they were outside, clubs have camera in the front entrance but not too far out so u dont know if they had cameras there where they were. It said they were on there way "out" meaning they most likely werent near the entrance of the club. Why is it always about money with you ppl?: the girl got slugged by a grown man as strong as marshall, she probably has no vision at all right now from the eye, give the girl a break and stop talkin about money for once in a situation like this, ffs.

    Usually, but not always. They can also be very clever schemers, which doesn't really mesh well with being impulsive. It really comes down to the individual. I agree with you, Marshall has always come off as impulsive to me. However, if he is receiving therapy for his disorder, I can pretty much guarantee that the major theme they are working on is having him slow down and think things through. More or less, it looks we are generally in agreement and just debating some specifics.

    I would be surprised if Marshall himself punched anyone. I think he may have been involved in a verbal altercation that ended with her getting hit by someone, but it probably wasn't him. Knowing his temper, I'd say with confidence that he was most likely involved in a shouting match or something. His name wouldn't get thrown into it if he wasn't involved in one way or another. I just doubt he did the punching himself...

    Don't really care for all the Marshall supporters out here, why isn't Calvin Johnson, Fitzgerald, Andre getting these type of issues? Oh that's right, because they never put themselves in that position.

    Thankfully we live in a country where peoples "belief" he did something doesn't make you guilty.

    Let's not judge and criticize either party until the facts, not hearsay, come out.

    Right now Marshall has not been charged and the police have not listed him as a suspect. So let the cops do their job and let's see what happens before dragging any individual through the mud.

    This is mostly true, I do IT work and we sometimes set up camera systems in Bars. Most of the cameras focus on employee behavior, usually a camera on the front door/Bouncers, and a few cameras on the bar and registers. Some bars use an outdoor camera to record the line out front or the waiting area in the front but not all. Most bar owners that I talk to are worried first about employee theft and bartenders that give away excessive amounts of liquor. secondly they want cameras spread around the bar so they can record when someone is kicked out of the bar so if someone tries to sue the bar they can show that they did not use excessive force. Every bar/club I have worked on has had just one camera focused on the front door area with multiple cameras on the bar and registers and a few sparsely in the bar/ dance floor area itself.

    The camera systems we use record very clear video but they don't record a high amount of Frames per second (usually because they have upwards of 16 cameras and are designed for remote web viewing) so a quick punch could be missed. But if someone was punched and then knocked down as she claims you would definitively see it. I suspect the camera systems being used in NYC bars are better than the average camera systems that I set up here in Albuquerque because despite my cities propensity for drinking & fighting I'm sure NYC night clubs that athletes attend have the money to spend slightly more on security that I see out here..

    I'm a New York Personal Injury Lawyer and personally know Sandy Rubenstein and his partener Reynicki. They are well connected court street attorneys. We have a case coming up where we each represent a plaintiff. They prepare well and get good results. Guaranteed- the civil case is coming. Depending on the level of injury to the eye, it could be worth north of 750k.

    not true. being a former police officer you have to have proof. yea they had camera's but in a big brawl like that what are the chances this was caught? and if this was caught on camera the truth would have already come out

    i agrre 100% and even then im not going to sit here and say ohhhh ohhhhh ohhhhh marshall hit somebody or a girl trade his *** , nobody knows that reads knows what happen but wheather it did or not, if he fit in what we are doin i would nt have traded him at all .

    Although Brandon Marshall had a monster game in the pro bowl..the NFL's version of flag football, he didn't exactly light it up while playing for the fins.

    Part of the deal for Marshall was that the Bears would sign FA Braylon Edwards so the two of them could practice dropping sure touchdowns and then go out clubbing afterwards. Have a few drinks, share a few laughs, beat up some small midgets and/or women.

    So why did she get hit in the eye, and who hit Marshall's wife with a bottle? If Marshall did hit her, i really doubt he just randomly decided to punch the girl in the eye for no reason. If she hit his wife with the bottle then legally and morally she should have gotten punch in the eye. LOL

    And i would like to add, if she played basketball then this is a big strong ugly chick lol

    I worked with camera a great deal back when I was in security, and the quality can vary a great deal depending on lots of factors. The biggest factor
    in this case would be low light. Cameras like that have very limited frame rate and focus at night. During the day they are freakin great though.

    My first platoon sergeant used to say that "nothing good ever happened downtown after midnight."

    16 or so years later, I've found his wisdom remarkable in it's accuracy.

    alot of ppl here are saying nothing good ever happens at night clubs, let me correct that statement. "nothing good ever happens around alcohol". Reminds me of growing up, everytime we drank liquor / beer something always happened and it was never a good thing.

    My prediction is, this girl was drunk and she let marshall have it with some harsh words, marshall himself probably had a few drinks himself and with his violent past, there was no way he was going to walk away with out takin a shot back. And no i dont mean a shot with words lol.
