While only recently has anyone suggested that Jonathan Martin might have any hint of a future in Miami, the Dolphins do still control his contractual rights.
So if he’s intent on playing again, they control to a certain degree where.
Agent Kenny Zuckerman told Andrew Abramson of the Palm Beach Post that he was meeting with Dolphins officials next week in Indianapolis to see what the next step is.
“We’re going to meet with the Dolphins at the Combine and see what their plans are,” Zuckerman said. “Right now they have his property, they have his rights.”
While it’s extremely unlikely that he could seamlessly return to Miami, there ought to be some degree of value for the former second-round pick.
“He will be on the field in 2014,” Zuckerman said of Martin. “There’s no doubt. He wants to, he’s ready, he’s excited. He’ll be somewhere this season.”
Maybe the team could hire him as the locker room and shower snitch. "It" has plenty of experience.
Miami has zero leverage in this. Martin has the team by the short and curlys now. Ross knows that Martin can sue the team for significantly more than his contract value. At this point any discussions between the two sides consists of Miami begging Martin not to sue. If Martin wants to come back and start at left tackle wearing a pink tutu the team will agree to it. If Martin wants to demand his release and full payment of his contract he will get it. He will get anything he wants.
This post has a lot of merit. Doesn't matter if he wants to come back or whatever, he has a massive upper hand legally. He can actually sue for lost wages for all the years of his expected playing lifespan. And if he instead tries to join a team and doesn't, it could get worse then. He can sue Miami and the NFL. I have no idea why some think this thing is done.
Uh, save the trip, Jon. You have no future with this team.

As an employer, if this situation occurred, Martin might have a decent shot at an EEOC claim for a hostile work environment. A civil suite for big money, is a stretch in my mind. Martin at no time, shared his complaints or concerns with his employer....in fact, there is plenty of evidence that exists to indicate Martin participated in the same type of behavior that he finds so repugnant in Richie Incognito. So I don't see how he can prove that the Dolphins organization willfully allowed this conduct to go on or how they are somehow liable even though he failed to make them aware of it?
I also don't know what the CBA contains regarding how an issue like this one would be handled.
oh btw, I believe SF has two 2nd's and 2 3rd rounders again. Its not out of the realm of possibility we could sneak a 4th or 5th from them because they have too many picks with not many spots left. At some point, they have to cash in.
Martin would give them great publicity, closer to home, and good depth.
